Question: buying house on auction?
Has anyone bought a house on auction? I could use any advice or pointers please. I am very interested in a property and the auction is on Feb 20th in the court house.
Can someone explain to me what this means;
TRUSTEE'S SALE OF (property address) In execution of a Deed of Trust in the original principal amount of $180,000.00, with an annual interest rate of 4.3750% from (owners names) dated April 30, 2004,
Does it mean I have to pay 4.3750% on the $180,000.00??? I am not sure.
Also do you know if we make the certified check in the attorneys name or the county treasurer.
So will the house bidding start at 180,000 ? And I don't have to worry bout the 4.3750%?
And I understand I have to have $15,000 certified check and come up with the rest of the money in 15 days.
Answer: I do not know why they listed the %, that is the interest rate the dead beats paid. Damn good interest rate too, I wish I had it!
The bank will be bidding about 162K (educated guess) so you will need to bid higher.
I would advise you to take an experienced (wish I could underline that!) broker with you to bid on your behalf. They are standardly paid 1%, but will sometimes take a flat fee.
The auction itself is going to take less then a minute, it could be over in a 10-15 seconds. If you are green you will not win this, as it takes too long to process exactly what is going on to take action.
The auction market is cut throat, with the bank itself being the biggest shark out there.
Have your guy (or you) start the bidding at about 90k, but be prepared for the bank to move it along quickly. They win most of these.

Question: Mom left a will, but not a trust. What happens to the house?
My fiance's mom passed away last December. He is the executor of the estate now, and we are not sure how to handle things. She left a will saying everything is to be split 50/50 between him and his brother. There is a property they have under a 1st level mortgage. His mom never left a trust for the deed to the house.
The house is in preforclosure proceedings, and we don't know what's supposed to happen from here. The heirs want to take possession of the house, but how can they do that with no trust being in place? There is still an outstanding mortgage with the bank, so technically the bank owns the property. How do things proceed from here and what can we legally do in the state of Arizona to acquire the house?
