Deed Of Trust Joint Tenants

deed of trust joint tenants
Question: Grant deed and my fathers foreclosure?

My fathers house is going into foreclosure. He refinanced two years ago 6/07 with a loan that is only under his name. Originally both of us were on the loan until the refi. We also both were originally on the title as joint tenants. On 12/07 I did a grant deed and removed my name from the title of the property to remove any interest I had in the property. Now the house is in foreclosure and the Bank Trustee company that is handleing the foreclosure sent seperate default notices to both of us referencing the original Deed of Trust date of 6/07 listing us still as joing tenants. It appears that they did not get their records updated with the new title with the county that has my father only. My question is this a simply a matter of them having the old records or is there some way that they still consider us joint tenants and therefore the foreclosure will affect my credit too???

Answer: The current lender should not have any "old records". Their interest in the property starts on the day they put their lien on the house (June,2007). All notices should go to the names on the new loan. It looks like they are going to mess up your credit if you don't correct this mistake.
Contact them by phone and letter saying that they are sending notices to the wrong person and you don't want their foreclosure to be invalid because they are not following the law. Don't mention your prior ownership.
