Question: I hold a Deed of Trust on raw land?
There are five people on title We started foreclosure One has filed bankruptcy We well soon get this dismissed.But now can the other 4 file, one at a time? If so what can you do ?
Answer: You need to see a Bankruptcy Attorney. He will file a motion for "Relief from Stay" for you.
The others can file for Bankruptcy also, but don't worry about it unless they do.
You may ask them via their Bankrupcty attorney or the Trustee at the Creditor's meeting if they will reaffirm their debt to you. They are under no obligation to reaffirm the debt. Do not attempt to contact them except through their attorney or the Bankruptcy Court.
